Terms of Service

These Terms of Service ("Terms") govern your use of the MyTakedown website and services operated by Arcate Labs LLC, a Wisconsin limited liability company ("MyTakedown," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Services Overview

MyTakedown provides online reputation management and content removal services, including but not limited to:

  • Free and paid reputation, exposure, and property scans
  • Content removal and takedown services across various online platforms
  • Data broker opt-out and removal services
  • Reputation monitoring and protection services
  • Personal brand building services

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. By using the Service, you represent that you meet these requirements. If you are using the Service on behalf of a business, you represent that you have authority to bind that entity to these Terms.

3. Account and Authentication

Certain features require authentication via magic link email verification. You are responsible for maintaining access to the email address associated with your account. You agree to provide accurate and complete information when using our Service.

4. Free Scans and Reports

We offer free scans that query publicly available information and third-party AI platforms. These scans are provided "as is" for informational purposes only. Scan results:

  • May contain inaccuracies, as they reflect third-party data and AI-generated content at the time of the scan
  • Are not legal advice, professional assessments, or guaranteed representations of fact
  • May change over time as underlying third-party data changes
  • Should not be relied upon as the sole basis for any decision

5. Paid Services

Pricing and payment

Pricing for paid services is provided on a per-case basis and may vary depending on the scope, complexity, and urgency of the work. All prices are in US dollars unless otherwise stated. Payment is due at the time of purchase unless a payment plan is agreed upon in writing.

Service delivery

We will use commercially reasonable efforts to perform the services described in your order. Timelines are estimates, not guarantees. Some removal requests depend on the responsiveness and policies of third-party platforms, which are outside our control.

No guaranteed outcomes

We do not and cannot guarantee that any specific content will be removed. The success of removal requests depends on factors outside our control, including but not limited to the policies and responsiveness of third-party platforms, the legal basis for removal, and the nature of the content. We commit to pursuing every reasonable avenue available to us, but the final decision to remove content rests with the platform hosting it.

6. Refund Policy

Our refund policy is detailed on our Refund Policy page. In summary: if after 60 days we have been unable to remove specific items included in your service, you are eligible for a 50% refund on those itemized line items.

7. Your Responsibilities

By using the Service, you agree to:

  • Provide accurate, truthful information about yourself and the content you want addressed
  • Only request removal of content that you have a legitimate basis to remove (e.g., it is about you, violates your rights, or is defamatory)
  • Not use the Service to suppress legitimate speech, news reporting, or public interest content
  • Not use the Service for any unlawful purpose
  • Cooperate with reasonable requests for information needed to process your case
  • Not interfere with or disrupt the Service or its infrastructure

8. Intellectual Property

All content on the MyTakedown website — including text, graphics, logos, icons, and software — is the property of Arcate Labs LLC or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

You retain ownership of any content or documents you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to use it solely for the purpose of providing the Service to you.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

MyTakedown is not a law firm and does not provide legal advice. Our services are operational and advocacy-based. If you need legal counsel, consult a licensed attorney.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCATE LABS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REPUTATION, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Arcate Labs LLC and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and dispute resolution) will survive.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be governed by the laws of the State of Wisconsin, without regard to its conflict of law provisions. You agree to resolve disputes through good-faith negotiation first. If negotiation fails, disputes shall be resolved through binding arbitration in Wisconsin, except that either party may seek injunctive relief in court for intellectual property violations.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
